Starting this Saturday, new rules introduced by the National Association of Realtors (NAR) will take effect, fundamentally altering how real estate professionals operate and, importantly, how you—whether a buyer or seller—will experience the buying and selling process.
These updates stem from a historic $418 million settlement related to antitrust claims, marking the most substantial shift in NAR’s regulations in at least a generation. Kevin Sears, NAR’s president, emphasized that these changes are designed to empower consumers, providing greater clarity and choice when buying or selling a home.
Here’s what you need to know:
Two Key Changes That Impact You
- Changes in Commission Advertising: Traditionally, sellers covered the commission fees for both their agent and the buyer’s agent, often totaling 5% or 6% of the sale price. For example, on a typical $450,000 home, sellers might pay around $27,000 in commissions. However, the new rules will prevent sellers’ agents from advertising commission rates to buyers’ agents on multiple listing services (MLS).
This means that buyers’ agents can no longer filter home searches based on commission fees, a practice known as “steering.” By eliminating this capability, the hope is to ensure that all homes are presented based on their merits rather than potential commission payouts, promoting fairness in the home-buying process. - New Buyer Representation Agreements: Starting this week, potential buyers must sign a legally binding representation agreement with their agent before viewing properties. This agreement serves a dual purpose: it clarifies how your agent is compensated and highlights that these commission rates are negotiable. If a seller opts not to cover the agent’s commission, buyers may be responsible for that payment.
These agreements are designed to encourage transparency and open negotiations regarding commissions. The idea is that by making buyers more aware of their options, we could foster a more competitive market, ultimately benefiting everyone involved.
